Scientific workshop “Improving the Management of the Rule-of-Law State for Harmonious Social Development”

Within 2 days, February 28th and March 1st of 2017, at Sheraton Hotel, No. 11 Xuan Dieu st., Hanoi, Institute of State and Law collaborated with Konrad Adenauer Stiftung (KAS) from Germany to organize the workshop on “Improving the management of the Rule-of-Law state for harmonious social development”

The workshop attracted nearly 200 participants from: the National Assembly, the Ministry of Justice, the Ministry of Planning and Investment, the Vietnam Academy of Social Sciences, Ho Chi Minh National Academy of Politics; and other participants from local bodies and law institutions.

 

On the side of the organizer, participants are: Mr. Peter Girke, Chief Representative Office of KAS Hanoi; Assoc. Prof. Nguyen Duc Minh, Director of Institute of State and Law; Dr. Pham Thi Thuy Nga, Deputy Director of Institute of State and Law.

 

Assoc. Prof. Dr. Nguyen Duc Minh

 

In the opening speech of the workshop, Assoc. Prof. Nguyen Duc Minh emphasizes the development of a sustainable and harmonious society as a necessary and objective trend. The workshop is held with a view to create a scientific forum for researchers, policy-makers, managers, teachers, and law practitioners from local and central bodies to debate, discuss on State management for harmonious social development. The workshop focuses on the value of a harmonious social development and its requirements for State management; identifies and evaluates the current situation of State management for harmonious social development. Thereby, the workshop discusses on certain solutions to improve the efficiency of State management to meet with the requirements for a harmonious social development.

 

Mr. Peter Girke also shares the ideas with Assoc. Prof Nguyen Duc Minh in his speech. He states that harmonious social development is the right direction for Vietnam in this transitional stage to a socialist-oriented market economy. Vietnam has made a number of achievements in socio-economic development; however, this development is not sustainable.

 

The workshop is organized with 12 presentations and receives 34 feedbacks from the participants.

 

The first session of the workshop is entitled “Management of the Rule of law for Harmonious Social Development”. This session include:

- “The role and responsibility of the Rule of law in ensuring a harmonious social development” – Prof. Dao Tri Uc (School of Law, Hanoi National University);

- “Economic growth associated with social justice in development management in Vietnam” – Assoc. Prof. Nguyen Nhu Phat (Institute of State and Law);

- “Legal policy on the harmonization of economic and culture development” – Dr. Nguyen Thi Thu Thuy (Institute of State and Law);

- “Managing conflicts and social consensus in the development process in Vietnam” – Prof. Vo Khanh Vinh (Graduate Academy of Social Sciences).

 

Prof. Dr. Dao Tri Uc

 

According to Prof. Dao Tri Uc, the development of a sustainable and harmonious society has brought up the question of State management in the development process of the country to meet new requirements. The Rule of law plays an important role in ensuring the country’s harmonious development through the practice of the principle of constitutional and law supremacy. The Constitution and law must be the basis for a harmonious social development. The State must identify, connect social benefits; promote and mobilize efficiently human resources. Where the Constitution is to be respected and strictly abided by, a new sustainable and democratic social order will be created.

 

Assoc. Prof. Nguyen Nhu Phat states several policy solutions for both economic growth and better resolution for social justice in a harmonious order:

- Change the model of economic growth. Continue to follow the spirit of the Constitution on liberalization and democratization of the economy.

- Strengthen market economy institutions. Reform national governance system with a clear distinction of the role of the State as master of the power (the creator) and as owner of the business (the investor). Publicity and transparency in the administration and governance of the State, especially in economic field; implement efficiently anti-corruption measures.

- Perfect and improve the policies and law on social security; mobilize social power to monitor the allocation of resources.

 

The second session of the workshop is entitled “State Management for a Harmonious Social Development in Some Countries and Suggestion for Vietnam”. Some State management experiences are introduced to meet with the harmonious development requirements from North European countries, China and South East Asian countries; thereby, it outlines certain implications for Vietnam.

 

In the morning of March 1st, the workshop comes to the last session of “State Management in a Number of Areas for a Harmonious Social Development in Vietnam”.

 

The workshop receives presentations from: Assoc. Prof. Nguyen Minh Phuong (University of Home Affairs) on “Impact Factors and Conditions to Ensure the Effectiveness of State Management for a Harmonious Social Development”; Prof. Nguyen Dang Dung (School of Law, Hanoi National University) on “Ensuring Human Rights in Harmonious Social Development in Vietnam”; Prof. Pham Hong Thai (School of Law, Hanoi National University) on “Reduce Wealth Gap in the Development Process in Vietnam”.

 

Assoc. Prof. Dr. Vu Thu

 

While analyzing social equality in management to meet the requirements of a harmonious social development in Vietnam, Assoc. Prof. Vu Thu (Institute of State and Law) proposes certain solutions: (i) Develop, perfect and reform social equality policies, (ii) Promote socialist democracy, ensure that all State powers belong to the people, (iii) State power must be in check, (iv) Develop a synchronized market economy, (v) Raise awareness of equality in social life.

 

According to Assoc. Prof. Nguyen Duc Minh, there are two parties in management: The manager and the managed. Therefore, conflict of interests is hidden inside this relationship. Thus, a harmonious solution for such conflict must be made. Also, it is necessary to establish a harmonious relationship among individuals in society. The purpose of management is to harmonize personal interests, and thereby, put the common interest of society as a standard for harmony between personal and social interest. One of the important factors to create social consensus and balance the interests between State and its people is to have the State ensuring and protecting human rights and citizenship.

 

At the end of the workshop, Assoc. Prof. Nguyen Duc Minh summarizes comments of the participants and opens up more issues in need of further research. On behalf of the organizer, Assoc.
